ThouHomar Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of ThouHomar, a web application available at thouhomar.xyz. By accessing or using ThouHomar, you agree to be bound by these Terms. If you do not agree, do not use the service.
These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act (DPDPA), 2023, and any other applicable Indian law.
1. About ThouHomar
ThouHomar is an experimental/beta web application that provides the following features:
- Transcript Downloads (Free, up to 10): Allows users to download publicly available transcripts of YouTube videos, subject to availability and YouTube's policies.
- Text Post Generation (Subscription Required): Generates text-based posts derived from YouTube video content, subject to the nature of the video and YouTube's policies.
All features are provided on a best-effort basis. ThouHomar makes no guarantees about the availability, accuracy, or completeness of any output.
2. Eligibility
You must be at least 18 years of age to use ThouHomar. By using the service, you represent and warrant that you meet this requirement. If you are using ThouHomar on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration
To use ThouHomar, you must create an account using one of the following methods:
- Google OAuth: Login via your Google account.
- Magic Link: A login link sent to your email address.
You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to notify us immediately if you suspect any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Free Tier and Subscription
4.1 Free Tier
Users on the free tier may download up to 10 YouTube transcripts in total. Once this limit is reached, further transcript downloads will not be available without a subscription or any future plan we may introduce.
4.2 Subscription
The text post generation feature requires an active paid subscription. Subscriptions are processed and managed through Dodo Payments. By subscribing, you agree to Dodo Payments' terms of service and authorize recurring charges as applicable to your selected plan.
All payments are final unless otherwise required by applicable law. We reserve the right to modify subscription pricing or features with reasonable notice.
4.3 Refunds
Given the experimental nature of ThouHomar, refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact us via our contact page. We are not obligated to issue refunds but will consider requests in good faith.
5. Acceptable Use
By using ThouHomar, you agree that you will not:
- Use the service for any unlawful purpose or in violation of any applicable law.
- Attempt to circumvent the free-tier usage limits through any technical or other means.
- Use the service to download, reproduce, or distribute copyrighted YouTube content in violation of YouTube's Terms of Service or applicable copyright law.
- Submit content or video URLs that are abusive, harmful, or violate the rights of others.
- Reverse engineer, decompile, or attempt to extract the source code of ThouHomar.
- Use automated scripts, bots, or crawlers to access the service.
- Interfere with or disrupt the servers or networks associated with ThouHomar.
6. YouTube and Third-Party Content
ThouHomar interacts with YouTube and its APIs to provide its features. By using ThouHomar, you also agree to comply with:
ThouHomar does not own, host, or claim any rights over YouTube videos or their transcripts. All YouTube content belongs to the respective video owners and is subject to their licensing terms.
ThouHomar may fail to retrieve transcripts or generate posts for any video. This can occur due to:
- The video not having a publicly available transcript.
- YouTube restricting access to the video or its data.
- Technical limitations within ThouHomar.
- Changes in YouTube's policies or API behavior.
Such failures do not constitute a breach of these Terms and do not entitle the user to any compensation or refund unless otherwise stated.
7. Intellectual Property
All software, design, branding, and original content of ThouHomar (excluding YouTube content) is owned by or licensed to ThouHomar. You may not copy, reproduce, or distribute any part of ThouHomar without our prior written consent.
Content generated by ThouHomar's post generation feature is derived from third-party YouTube videos. You are solely responsible for ensuring your use of such generated content complies with applicable copyright law and YouTube's Terms of Service.
8. Disclaimers
8.1 Beta / Experimental Service
ThouHomar is in an experimental/beta stage. The service is provided "as is" and "as available", without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 No Guarantee of Availability
We do not guarantee that ThouHomar will be available at all times. The service may be interrupted, suspended, or permanently terminated at any time without prior notice. This is particularly relevant given the experimental nature of the application.
8.3 Accuracy of Output
Transcripts fetched and posts generated by ThouHomar may contain errors, inaccuracies, or incomplete information. You should independently verify any content before relying on it.
9. Limitation of Liability
To the fullest extent permitted by applicable law, ThouHomar and its developers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
- Your use of or inability to use the service.
- Failure to retrieve transcripts or generate posts.
- Loss of data or account access.
- Termination or suspension of the service.
- Any third-party actions, including those of YouTube, Google, or Dodo Payments.
In no event shall our total liability to you exceed the amount you paid to ThouHomar in the three (3) months preceding the event giving rise to the claim.
10. Termination
10.1 By You
You may stop using ThouHomar at any time and request account deletion by contacting us via the contact page.
10.2 By Us
We reserve the right to suspend or terminate your account and access to ThouHomar at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.
10.3 Service Termination
ThouHomar may be permanently shut down at any time, depending entirely on the success of this beta phase. In such an event, we will make reasonable efforts to notify active users in advance, but cannot guarantee a specific notice period.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your use of ThouHomar shall be subject to the exclusive jurisdiction of the courts of India.
We encourage you to contact us first at thouhomar.xyz/contact to resolve any disputes informally before pursuing legal action.
12. Changes to These Terms
We may revise these Terms at any time. Updated Terms will be posted at thouhomar.xyz with a revised "Last Updated" date. Your continued use of ThouHomar after any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the service.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThouHomar regarding your use of the service and supersede any prior agreements.
